My elder brother aged 35 is a mentally ill certified as 60% disability with permanent disability, suffering from schizophrenia. I am taking care of his financial and medical requirements. But my father is retired employee of BSNL.He is getting 12,800 Rs.as pension. So can I claim tax benefit for my elder brother. My father is not getting any tax benefits. I am a central government employee aged 32.I am confused about my brother’s dependent status.

    The section for dependant disability is applicable for:

    11DD . (1) For the purposes of section 80DDB, the following shall be the eligible diseases or ailments :

    (<i>i</i>) Neurological Diseases where the disability level has been certified to be of 40% and above,—
    (<i>a</i>) Dementia ;
    (<i>b</i>) Dystonia Musculorum Deformans ;
    (<i>c</i>) Motor Neuron Disease ;
    (<i>d</i>) Ataxia ;
    (<i>e</i>) Chorea ;
    (<i>f</i>) Hemiballismus ;
    (<i>g</i>) Aphasia ;
    (<i>h</i>) Parkinsons Disease ;
    (<i>ii</i>) Malignant Cancers ;
    (<i>iii</i>) Full Blown Acquired Immuno-Deficiency Syndrome (AIDS) ;
    (<i>iv</i>) Chronic Renal failure ;
    (<i>v</i>) Hematological disorders :
    (<i>i</i>) Hemophilia ;
    (<i>ii</i>) Thalassaemia.

    and the dependant includes Wholly/Mainly dependent brother.

    So in your case every thing is covered except the allowable disease. What you can do is if you can get the Form  – Provided <i>that where in respect of any diseases or ailments specified in sub-rule (1), the patient is receiving the treatment in a Government hospital, the prescription may be issued by any specialist working full-time in that hospital and having a post-graduate degree in General or Internal Medicine or any equivalent degree, which is recognised by the Medical Council of India</i>. to claim the deduction.

      Thanks Madhuri for the reply.My doubt is whether my elder can be considered as a dependent on me, as my father is getting pension.My brother who is 35 years old has already received physical disability certificate of 60% disability from chief medical officer of my district. I have read somewhere especially for mentally ill person his siblings can get tax rebate. Is it valid?
